Due to “Deception and Misrepresentation,” “Hershey” urged to pay $5 Million
Chocolate industry giant “Hershey” is facing a lawsuit from an angry woman who claims that the Halloween-themed candy does not resemble the shape depicted on the packaging.
Cynthia Kelly from the state of Florida in the United States alleges that she purchased the candy because she liked its “artistic design.”
She adds that she was drawn to “the cute eyes and mouth” that appear on the peanut butter cup candy inspired by the Halloween theme, prompting her to buy it for $4.49.
She highlighted that “after opening the package, she found neither Halloween features nor any engravings at all” on the chocolate.
In her lawsuit, Kelly accuses the American company of “misrepresentation,” demanding compensation of no less than $5 million or 1.1 million pieces of peanut butter cup candy.
The legal claim stated: “Many consumers were deceived and misled by the images on the product’s packaging.”
She adds that this is not just about Halloween candy but also another product with a football theme, which does not contain what is shown on the packaging.
